Personal Injury Occurring in the Workplace
In Washington, workers injured on the job file claims for workers’ compensation benefits with either the Department of Labor and Industries (“L&I”) or with a self-insured employer. An injured worker’s sole remedy for a workplace accident is ordinarily through the workers’ compensation process.
However, some workplace injuries are caused in whole or in part by someone other than an employer, employee or co-worker – a so-called “third party”. For instance, a construction worker employed by a general contractor may be injured by a subcontractor, or as a result of defective equipment.
In workplace injuries where a third party is at fault, the injured worker is entitled to bring a claim against that third party in addition to filing a workers’ compensation claim with his or her employer. We have extensive experience in third party claims.
